Lasting Powers of Attorney

LASTING POWERS OF ATTORNEY If someone has not made a Lasting Power of Attorney or an Enduring Power of Attorney and they lose mental capacity to deal with their affairs and make decisions for themselves, you may wish to assist them by making an Application to become a Deputy for that person to the Court of Protection. An Application to become a Deputy can take between 4 to 6 months (based on our experience) to complete due to the length of time needed to process such applications. 

To avoid the need for this Application becoming necessary, should someone become mentally incapable in the future, they should complete a Lasting Power of Attorney.  This will allow them to chose whom they wish to deal with their affairs and make decisions for them should they become mentally incapable of doing so.
